We are printing, by kind permission of the Law Commission, two sections of the report of the Law Commission on injuries to unborn children. This report was the result of a request to the Law Commission by the Lord Chancellor at the time (Lord Hailsham of Saint Marylebone) to advise on `what the nature and extent of civil liability for antenatal injury should be'. The Law Commission followed its usual practice in such circumstances of consulting various bodies and obtaining expert (...) advice on the subject and then embodying the results in a working paper (Working Paper No. 47 - injuries to unborn children) published on 19 January 1973, which preceded their report (Cmnd 5709). Meanwhile a Royal Commission is considering much wider issues of civil liability for injury (including antenatal injury) but the terms of reference for the Law Commission were much narrower and confined to the position of children injured before birth. In the section relating to the present law the report makes it clear that it is probable that liability under the common law already exists. The Scottish Law Commission has also issued a report (Cmnd 5371). They were given different terms of reference and came to somewhat different conclusions. We are printing from this long report the paragraphs discussing the medical background and the summary of recommendations. As will be evident on reading the paragraphs on the medical background to injuries to the unborn child, events are moving very rapidly, particularly in the study of congenital defects and the effects of drugs but the problems of proof present great difficulty. Other causes of injury to the unborn child are better known to the general public: for example, those following the illness, infection and disease of the mother during pregnancy, injury caused in attempted termination of pregnancy and the risks resulting from the mother's condition. The summary of the recommendations sets out very clearly the legal position of the unborn child, as the Law Commission sees it, arising from injury before birth, the final conclusion being that `legislation is desirable'. These extracts from the report, apart from their intrinsic interest, lead on to the paper by Mr Kennedy and Dr Edwards in which they set out their criticisms of it, and provide quick references to the original document. Most documented extinctions of vertebrates in the last 400 years have been island endemics. In this paper, we focus on the need to develop a historical framework to establish conservation priorities for insular faunas and, in particular, to test the validity of nominal endemics. We use the example of the islands of the North Pacific Coast of North America, a region that includes approximately one-half of all mammals endemic to North American islands north of Mexico. Few of these endemics have (...) been re-evaluated since their original descriptions, although many of these islands have been heavily impacted by habitat conversion, species introductions, over-exploitation, and secondary ripple effects. Evidence from molecular genetics and paleontology suggests that many taxa arrived in the region since the last glacial advance. Some of these nominal endemics show minimal differentiation, while others comprise multiple evolutionary lineages. The NPC may also have played an important role in the in situ diversification of some taxa during the Pleistocene. Evidence, such as new fossil discoveries and numerous described endemics, lends support for refugia hypotheses. However, these ideas cannot be tested until a better understanding of geographic variation and the evolutionary relationships of the fauna and flora of the North Pacific Coast is developed. This framework would provide significant insight into the dynamic biogeographic history of the region and help prioritize conservation efforts. (shrink)

1 Evidence-based policy requires researchers to provide the answers to ecological questions that are of interest to policy makers. To find out what those questions are in the UK, representatives from 28 organizations involved in policy, together with scientists from 10 academic institutions, were asked to generate a list of questions from their organizations. 2 During a 2-day workshop the initial list of 1003 questions generated from consulting at least 654 policy makers and academics was used as a basis for (...) generating a short list of 100 questions of significant policy relevance. Short-listing was decided on the basis of the preferences of the representatives from the policy-led organizations. 3 The areas covered included most major issues of environmental concern in the UK, including agriculture, marine fisheries, climate change, ecosystem function and land management. 4 The most striking outcome was the preference for general questions rather than narrow ones. The reason is that policy is driven by broad issues rather than specific ones. In contrast, scientists are frequently best equipped to answer specific questions. This means that it may be necessary to extract the underpinning specific question before researchers can proceed. 5 Synthesis and applications. Greater communication between policy makers and scientists is required in order to ensure that applied ecologists are dealing with issues in a way that can feed into policy. It is particularly important that applied ecologists emphasize the generic value of their work wherever possible. (shrink)

Food media have become a formidable part of adolescents’ food environments. This study sought to explore how and why adolescents use food media by focusing on selectivity and motives for consumption. We conducted in-depth, semi-structured interviews with 31 Flemish adolescents aged 12 to 16. Food media were both incidentally consumed and selectively sought for education, social utility, and entertainment. The levels of selectivity and motives for consumption varied among the different food media platforms. Incidental consumption was more prevalent with TV (...) cooking shows compared to online food media. The dominant motives for TV cooking show consumption were companionship and entertainment, while online food media were used for a more diverse range of motives dominated by information/inspiration and social interaction. Some participants consumed food media to get motivation and inspiration to improve health and fitness while others consumed food media to watch appetizing and aesthetically pleasing food content. The social environment in the form of friends and family as well as existing food preferences were dominant psychosocial factors for both traditional and online food media use. Future research is warranted to explore how incidental exposure and the identified motives for use relate to food media effects. (shrink)

In the introductory chapter to this collection, the editors point out that, until recently, most Anglophone Spinoza scholarship has been focused on the metaphysics and epistemology of the Ethics. But according to Kisner and Youpa, Spinoza thought that metaphysics and epistemology were significant chiefly because they are required for understanding the more important part of his project—the ethical doctrine developed in the last three parts of the work. The excellent article in the January number of the Classical Quarterly upon a mistaken interpretation of Philebus 31 c contains the somewhat incorrect statement that this interpretation is the general one: and the article itself is anticipated by a short note in a paper which I published in the Transactions of the Oxford Philological Society for 1881–2. I have nothing to complain of, for it may partly serve me right. Besides, my paper, though duly registered in the Revue de Philologie, (...) is omitted from the index of that periodical; the aforesaid Transactions are out of print, and by some mischance my correction of the wrong rendering did not appear in the last edition of Jowett's Plato, though Jowett intended it should. It is McRae’s “position that the link between absolute knowing, and the system proper [in Hegel], cannot be understood aside from the act of presentation itself”. In a word, “absolute knowing is nothing but the presentation of the system itself”. This ongoing activity of presentation occurs in the theater of language, there being different speculative levels as well as particular “regional” languages, each in its own way capturing, in its “thick immediacy,” some stage of this process. "No, your honor. I didn't know who or what he was when I first came across the book -- they don't exactly love him in the synagogue, if you've read the story of his life. I found it in a junkyard in a nearby town, paid a kopek, and left cursing myself for wasting money hard to come by. Later I read through a few pages and kept on going as though there were a whirlwind at my back. As I (...) say, I didn't understand every word but when you're dealing with such ideas you feel as though you were taking a witch's ride. After that I wasn't the same man. That's in a manner of speaking, of course, because I've changed little since my youth.". The speaker is Yakov Bok, the unlikely hero of Bernard Malamud's The Fixer. At this point, early in the novel, Yakov speaks truthfully when he says that he has changed little since his youth. But over the next two and a half years (the time-period covered in the novel), he will undergo profound change and impressive moral growth. He suffers; he learns; he grows. Spinoza's name and ideas appear again and again at crucial moments in the course of the hero's moral development. Yakov Bok's verbal account of Spinoza's ideas is often comically primitive, but his understanding far outstrips his ability to articulate. By the end of the novel, his sufferings have led him to a deep grasp of certain of Spinoza's ethical and political doctrines. (shrink)

The recently published Cambridge Companion to Spinoza contains a fine essay by Pierre- Francois Moreau on Spinoza’s reception and on his influence during the more than three hundred years that have passed since his death. In Moreau’s twenty-five page article we find a brief paragraph on the novelist George Eliot and half a sentence on Ed Curley. There is not another mention, at all, of any other philosopher from an English-speaking land since the seventeenth century – nothing on how Spinoza’s (...) ideas were received in England, North America or Australia. Not a word on any influence that Spinoza might have had on later thinkers in those countries. (shrink)

An explanatory gap exists between physics and experience, raising the hard problem of consciousness: why are certain physical systems associated with an experience of an external world from an internal perspective? The living mirror theory holds that consciousness can be understood as arising from the computational interaction between a living system and its environment that is required for the organism's existence and survival. Maintaining a boundary that protects the system against destructive forces requires an interaction between the organism and its (...) outside world that can be cast in terms of Bayesian inference. The living mirror theory holds that this computational interaction results in statistical properties of the material world that are, in the absence of life, only implicit, becoming explicit in informational terms. This is held to give rise to the beliefs in qualities that constitute consciousness. Consciousness is therefore a necessary feature of all living systems as, in a world governed by the second law of thermodynamics, survival depends on the construction of beliefs regarding the potentially destructive forces in the outside world. From this perspective, consciousness is shown to be not a property of the brain in particular but instead to be a necessary feature of the life process itself. (shrink)

According to Colerus, Spinoza replied affirmatively when his landlady asked if she "...could be saved in her faith." This paper asks what Spinoza could have meant -- and what his landlady would have thought he meant. She was asking about salvation of a certain kind -- a kind that Spinoza did not in fact believe to be possible. When he talks about salvation in his writings, he has in mind a different kind of salvation -- one that his landlady will (...) certainly not achieve "in her faith." So, when he assured her that she could be saved in her faith was he simply lying to her? This question is explored against the background of the controversies regarding Spinoza's sincerity in the Tractatus Theologico-politicus. (shrink)

The Serbian Orthodox Church has been described in scholarship as having had a significant impact onto the social and political life of Serbia, especially since the wars of the nineties. With the coming of the age of the Internet and social science automation, however, more options have gradually become available to researchers in the recent years. For this reason, this article will tackle the official rhetoric of the Serbian Orthodox Church in relation to the sociopolitical with the assistance of social (...) science automation. Forming an examination via the methodological lens of Operational Code Analysis, this article delves into the Church’s discourse on Kosovo, via heavy vetting of all official statements given on the website of the Serbian Orthodox Church. It also expands upon the initial methodology – Operational Code Analysis – to an analysis of an institution with a uniform discourse, which has so far not seen light in scholarly production. Then, at the turn of the century, he began to argue that archaeological evidence demonstrated that the Achaean warriors described by Homer were in origin Germanic tribesmen from north of the Alps who had but recently conquered Mycenaean Greece. A fairly comprehensive survey of his writings leads to the suggestion that, in Ridgeway's opinion, Achaean invasion had left little lasting impact upon most early Greek social institutions, but that it had been responsible for a fundamental shift from matriarchy to patriarchy, and that this shift was the key to the subsequent greatness of Greek—and so ultimately Western—civilisation. In Göttliche Gedanken (Godly Thoughts), Andreas Schmidt provides an in-depth discussion of the metaphysics of knowledge and of mind in four early-modern rationalists: Descartes, Malebranche, Spinoza, and Leibniz. His topic overlaps with what is called “philosophy of mind” in contemporary Anglo-American circles, for he is quite interested in the relation between mind and body in these four historical thinkers. But as Schmidt effectively reminds us, the “mind-body problem” looks entirely different when embedded in the conceptual setting of the seventeenth century. (...) During Leibniz's lifetime, interest in the interpretation of the Bible and biblical prophecy became central to the theological and political concerns of Protestant Europe. Leibniz's treatment of this phenomenon will be examined in the light of his views on the nature of revelation and its role in his defence of Christianity. It will be argued that Leibniz's defence of the miracle of revelation (and its vehicle, biblical prophecy) – unlike his arguments on behalf of the core Christian mysteries of the (...) Trinity and Incarnation – is demonstrable by purely natural and scientific means, especially the verification of history. (shrink)

G. W. Leibniz has been praised as an exemplar of tolerance on both theological and political grounds. His irenic efforts within Christendom as well as his positive attitude towards pagans like the Chinese is well documented. He thought that “the great majority of mankind” were already “civilized”. This paper highlights Leibniz’s political treatment of the “uncivilized” peoples, whom he termed “barbarians” and “savages”. Given Leibniz’s worldly outlook and prodigious reading, including writings detailing the horrors inflicted on the natives of the (...) Americas, he blithely ignored a reality that was quite at odds with his own vision for such peoples. The dissonance between his ideas on how to treat “barbarian” peoples (whom he considered to be fully human and deserving of mutual respect) and his awareness of their actual treatment in many nascent European colonies is striking. The only conclusion that can be reached (though Leibniz never says so explicitly) is that their conversion to Christianity and the consequent enlightenment of their posterity trumped their present suffering. Alyne da Silva Pimentel Teixeira died of postpartum hemorrhage following the stillbirth of a 27-week-old fetus on November 16, 2002 in Rio de Janeiro, Brazil. Her death led in 2011 to the first decision of an international treaty body holding a government accountable for a preventable maternal death. The decision, Alyne da Silva Pimentel Teixeira v. Brazil, was given by the Committee on the Elimination of Discrimination against Women, established to monitor compliance by member states with the UN Convention on (...) the Elimination of All Forms of Discrimination against Women. The decision upheld a complaint, filed in 2007 against the state and government of Brazil, finding discrimination in the field of health care for Alyne’s avoidable maternal death, in breach of the Women’s Convention. This paper presents an overview of the dimensions of unsafe motherhood, contrasting data from economically developed countries with some from developing countries. It addresses many common factors that shape unsafe motherhood, identifying medical, health system and societal causes, including women's powerlessness over their reproductive lives in particular as a feature of their dependent status in general. Drawing on perceptions of Jonathan Mann, it focuses on public health dimensions of maternity risks, and equates the role of bioethics in conscientious medical care (...) to that of human rights in public health care. The microethics of medical care translate into the macroethics of public health, but the transition compels some compromise of personal autonomy, a key feature of Western bioethics, in favour of societal analysis. Religiously‐based morality is seen to have shaped laws that contribute to unsafe motherhood. Now reformed in former colonizing countries of Europe, many such laws remain in effect in countries that emerged from colonial domination. UN conferences have defined the concept of ‘reproductive health’ as one that supports women's reproductive self‐determination, but restrictive abortion laws and practices epitomize the unjust constraints to which many women remain subject, resulting in their unsafe motherhood. Pregnant women can be legally compelled to give the resources of their bodies to the support of others, while fathers are not legally compellable to provide, for instance, bone‐marrow or blood donations for their children's survival. Women's unjust legal, political, economic and social powerlessness explains much unsafe motherhood and maternal mortality and morbidity. (shrink)
